Mazur: The appeal is allowed

The Court of Appeal have allowed the appeal from the High Court in the matter of Mazur -v- Charles Russell Speechlys LLP. Lady Justice Andrews has clarified that persons not authorised to conduct litigation may still still do so as long as the work is completed on behalf of an authorised person. Such supervision could be evidenced by meetings or speaking with the unauthorised person regularly on individual cases. The question is who retains overall responsibility.
LJ Andrews clarifies that “the question in any given set of circumstances will be whether the unauthorised person, in carrying out whatever tasks which fall within the scope of “conduct of litigation” have been delegated to him or her, is in truth acting on behalf of the authorised individual. If they are, it is the authorised individual who is conducting the litigation. But if the reality is that the litigation is not being conducted by the unauthorised person for and on behalf of the authorised individual, they will be committing an offence.”
The judgment provides needed clarification as to who can conduct litigation within the scope of the Legal Services Act 2007.
